Thanks for your interest in Bublish’s Partner Program. This document outlines the term and conditions of the Bublish Partner Program. This agreement commences upon Bublish’s acceptance of a Partner’s registration by email. Either party may terminate this agreement at any time, with or without cause, with a written note sent via mail or email.

Definition of Terms

The following terms are used throughout this agreement:

User is anyone visiting bublish.com while browsing the Internet.

Buyer refers to any User that has completed a purchase for services on bublish.com.

Partner is any person who has joined the Bublish Partner Program and is subject to the program’s terms and conditions. Any reference to “you,” “your,” or “yours” within this document refers to the Partner.

Bublish is the manager of the Bublish Partner Program and author of this document. Any reference to “we,” “us,” or “our” within this document refers to Bublish.

Partner Link(s) is the affiliate link that will be unique to each Partner in the Bublish Partner Program. This is the link used to track eligible commissions. Please read about restrictions and conditions in this document that apply to Partner Links.

Becoming a Bublish Partner

In order to become a Bublish Partner, you agree to:

• Register for Bublish’s Partner Program, provide requested contact information, and agree to the terms and conditions in this document as part of the registration process.
• Be accepted into Bublish’s Partner Program in order to participate. Acceptance is at the discretion of Bublish. Please note: A Bublish Partner account and dashboard is separate from a Bublish author or reader account and dashboard. As such, different terms and conditions apply to each. In the case of Bublish’s Partner Program, the terms and conditions outlined in this document apply above all others, should there be a conflict of terms or conditions.
• Have an active PayPal account with a registered Employer Identification Number (EIN) for businesses or Social Security Number (SSN) for individuals or businesses without an EIN in order to receive commission payments from the Bublish Partner Program. One of these Federal Tax IDs must be provided to PayPal in order for you to be eligible for participation in our Partner Program.
• Refer new clients to bublish.com for self-publishing services including editing, formatting, ebook conversion, cover design, marketing, publishing packages, etc.
• Maintain a current Partner address and other relevant contact and tax identification information on your Bublish Partner dashboard.

Please note that emails, phone calls, or any other communication with Bublish will NOT establish you as a Publishing Partner. You must complete our online registration process to qualify and then be accepted into the program.

Partner Commissions

Once you have set up your account and been approved for the Bublish Partner Program, you will be able to generate a unique Partner Link, which you can share and advertise. For each User purchasing services on bublish.com by means of your Partner Link, you will become eligible for a commission equal to ten (10) percent of the total purchase price before taxes for that User’s first purchase. As mentioned, Amazon and Facebook advertising services, as well as Bublish subscriptions, are excluded from Bublish’s Partner program. Please note: the act of sharing your Partner link does not make you eligible for a commission. It is only when a User makes a purchase on bublish.com via your Partner Link that you become eligible for a commission—and other terms and conditions may apply.

Cookies

Bublish uses cookies to track Users that reach bublish.com by means of your Partner Link. If a User does not allow cookies or clears their cookies, we will not be able to track your Partner Link and therefore not be able to pay you a commission. Similarly, if a User visits bublish.com from a browser that does not allow or support cookies, we will not be able to track your Partner Link and therefore not be able to pay you a commission. When cookies are present, they are typically available for 30 days. If a User visits bublish.com via your Partner Link but doesn’t make a purchase until after the 30-day mark, the purchase will no longer be trackable via your Partner Link so the transaction will not be eligible for a commission.

Additional Terms and Conditions

Users that purchase Bublish services through your Partner Link cannot be Bublish employees or Users with their own Bublish Partner account. If such transactions do occur, they will not be eligible for any commission payments. You cannot earn a commission on your own purchases on bublish.com. Additionally, Bublish has the right to exclude certain products, programs, services, and/or promotions from the Partner Program at our discretion. Commission will not be paid on products, programs, services, and/or promotions that have been excluded from the Partner Program. Bublish will do its best to inform you of these exceptions but is not obliged to do so. As stated earlier, Amazon and Facebook advertising services, as well as Bublish subscriptions, are always excluded from Bublish’s Partner Program.

If a User visits bublish.com via more than one Partner Link, the first link the User accesses is the only link that will generate a transaction eligible for commission. To clarify, if a User reaches bublish.com through your Partner Link first, then visits a second time via another Partner Link within a 30-day period, your Partner Link will generate the transaction that is eligible for a commission. Additionally, commissions are only generated on the total purchase price for the first transaction completed via your Partner Link.

Payments

These are the details regarding commission payments for the Bublish Partner Program:

Minimum Threshold

There is no minimum threshold for Bublish to pay Partners an earned commission. However, other terms and conditions may apply as outlined in this document. Please review them carefully.

Payment Dates

Partners with approved commissions will automatically be paid on the 20^th of each month as long as they have an active PayPal account and have adhered to all the terms and conditions outlined in this document. However, there is a ten (10)-business-day holding period before transactions are approved for eligible commissions. This holding period helps to ensure that the Buyer’s transaction has cleared the bank successfully, and that the Buyer has not requested a refund for any of the services purchased in a particular transaction. Should a purchase related to your Partner commission earnings be subject to a refund or chargeback, Bublish can, at its discretion, withdraw that particular commission from your total Partner commission earnings.

Payment Methods

Partners must have an active PayPal account in order to be paid any eligible commissions from the Bublish Partner Program. PayPal is currently the only payment method available for the Bublish Partner Program. As mentioned earlier, your PayPal account must have either a registered Employer Identification Number (EIN) if you run a businesses or Social Security Number (SSN) if you are an individual or running a business without an EIN. Whether you reside in the United States or outside the US, one of these Federal Tax IDs must be provided to PayPal in order for you to be eligible to participate in the Bublish Partner Program and be paid commission.

Fees and Currency Conversions

Bublish only issues commission payments in US dollars (USD) to eligible Partners on accepted commissions. Bublish is not responsible for currency conversions or reimbursement of conversion costs or any other transaction fees that PayPal or your financial institution might apply. These costs and fees are solely the responsibility of the Partner, not Bublish.

Partner Contact Information

It is the Partner’s responsibility to notify Bublish of any changes in their contact or PayPal account information. Bublish will not be responsible for outdated account information and cannot be held responsible for commission payments that are undeliverable due to missing, erroneous, or outdated Partner contact or PayPal account information. It is the Partner’s responsibility to update information via their Partner dashboard.

Protection of Users

Partners who act against the intended purpose of the Bublish Partner Program will become immediately ineligible to be a Partner and may have their access to the Bublish Partner Program removed at Bublish’s sole discretion. Bublish will pay all eligible, earned royalties before the removal date. Here are some important guidelines we have put in place to protect Users:

• Partners cannot attempt to confuse, mislead, or deceive Users.
• Partners cannot attempt to confuse, mislead, or deceive Bublish, Bublish users, or the public at large.
• Partners cannot use Bublish trademarks, domains, or intellectual property when promoting their Partner Link.
• Partners cannot purchase a domain name, search engine keywords, or pay-per-click advertisements that use Bublish’s trademarks or any possible variation of those trademarks.
• Partners cannot act against Users in any form that violates the law, including spam, privacy, intellectual property violations, fraud, or any other action that intentionally deceives customers.
• Partners cannot act in direct or indirect contravention to the Bublish Partner Program’s terms and conditions, nor behave in a way that does not conform to Bublish’s standards.

With the protection of Users in mind, Bublish reserves the right to disable a Bublish Partner account at our discretion at any time, for any reason, and without prior notification.

General

The terms and conditions of the Bublish Partner Program are subject to change or termination without notice, except for eligible commissions issued prior to the effective date of such changes or termination. Any changes to the terms of Bublish’s Partner Program on bublish.com shall be deemed adequate and full notice to all Partners. The terms hereof cannot be modified except through our website or through written communication from Bublish CEO Kathy Meis.

This agreement shall be governed under the laws of the State of Delaware, and unless Bublish elects otherwise, any dispute under this agreement shall be resolved only in the courts located in the State of Delaware to which jurisdiction all Partners hereby submit.
