According to the US Copyright Act, Section 101 47, without any contract to indicate differently, the collective work of partners is considered to be owned equally and jointly by the authors. 48 In documenting their agreement, the partners are not bound by the Copyright Act section that requires that royalties be split equally among the owners of the copyright. They may choose to split in any ratio they prefer.
Once the contract is signed, it is legally enforceable and the partners’ official relationship has begun. 49 Each partner should retain a copy of the signed contract. The value of flexibility becomes self-evident as the partners explore their relationship, develop their organizational structure and routines, and work to accommodate one another’s needs. All decisions affecting the partnership and their work should be collaborative, with the contract serving as the primary resource when issues require resolution.
