This excerpt demonstrates the power of the Press. There has been quite a bit in the news on the power of the Press, freedom of speech and defamation. Dominion Voting Systems brought a $1.6 billion defamation lawsuit against Fox News, which is headed to a jury trial. The trial is pending in Delaware and Judge Eric Davis is overseeing the case. The trial is set to begin April 17, 2023. One of the main issues will be whether Fox acted with actual malice in broadcasting statements that the Judge has ruled are defamation per se (by their nature). The Press gets a good amount of its power from the First Amendment to the Constitution. The Founders wrote, "Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances." The First Amendment remains particularly relevant more than 200 years after it was authored. However, little is known about what the Framers meant at the time. There is little record of debate about the intended purpose in the First Congress, which is where the Bill of Rights was proposed. Since then, our Judiciary has flushed out the meaning and extent of these rights in a series of court cases. like the one about to proceed to a jury in Delaware.
